Job Description

The Senior Legal Counsel will be responsible for providing legal advice on a broad range of complex legal and regulatory matters related to marketing, advertising, intellectual property and privacy. The successful incumbent will also support the business in its related compliance efforts and draft, review and negotiate agreements and contracts related to client facing materials, and provide sound legal risk analysis in relation to compliance and legal processes.

Responsibilities

  • Support to the General Counsel and Secretary by providing strategic legal and regulatory compliance advice (Health Canada, FDA, FTC) and services to clients
  • Negotiate, revise and review a range of general commercial, marketing,  advertising, intellectual property and privacy documents in relation to various transactions, including identifying risks
  • Maintain current knowledge of developments in the law, specifically relating to  marketing, advertising, intellectual property and privacy
  • Recommend improvements for consistency with market practices and assist in the design of legal advice strategies and approaches for the department
  • Ensure that the policy framework and related practices in place are adequate

Qualifications & Skills Requirements

  • LL.B or JD from a recognized law school
  • Membership in good standing with the Law Society of Ontario
  • 4 to 6 years of post-qualification practice as either in-house counsel or with a well-recognized law firm, where the candidate has developed and focused on advertising, IP and regulatory compliance ( Health Canada, FDA, FTC )
  • Strong client skills, an ability to work autonomously by taking ownership of projects (especially when analyzing legal risks), flexibility to adapt quickly to changes and able to work in a fast-paced environment
  • Effective and concise communications in a variety of formats and venues to a wide audience

What is Required?

  • Hold a Bachelor of Laws degree and be a member of the Ontario Bar;
  • 5 to 7 years of experience in corporate and commercial law;
  • Relevant experience with PPP-type contractual agreements (essential);
  • Working knowledge of the construction industry;
  • Excellent negotiation and persuasion skills;
  • Possess strong legal argumentation skills, both verbally and in writing;
  • Have a perfect command of English and a good knowledge of French;
  • Good knowledge of computer tools and work-related software;
  • Demonstrate judgment, initiative, leadership, autonomy, versatility and team spirit;
  • Solution-oriented, analytical mind;
  • Ability to work under pressure and perform tasks within a tight schedule;

  • Establish, communicate and manage workflows for judgment accounts assigned to Canaccede’s legal network across Canada
  • Identify and continuously improve key performance metrics for legal accounts and workflows
  • Work with consumers, their representatives or Canaccede’s legal network to finalize settlements or respond to any disputes, defences or motions filed
  • Maintain legal reports and provide recommendations for optimal strategic decisions
  • Provide advice and support the continual compliance with the organization’s policies and procedures with all applicable laws and regulations
  • Support the General Counsel and Director, Legal Services and Enterprise Risk in providing a full spectrum of in-house legal services

What qualifications are required for this position?

  • LLB or JD from an accredited Canadian University
  • Minimum 3 years litigation experience, preferably with exposure to distressed debt collections
  • Familiarity with collection laws in all Canadian provinces
  • Exceptional time management and organizational skills
  • Ability to build and maintain lasting relationships with business partners
  • Accuracy and attention to detail while working on competing priorities under tight deadlines
